Power of Attorney to Sell Property: Authorise an Agent for a Sale

A power of attorney to sell property lets another person sell your flat, villa or plot for you. You stay the owner until the sale completes. The agent signs where you cannot be.

Three ways to get it notarised

In person with our in-house notary public

The notary public checks the owner's original ID, reads the document, watches you sign and applies the seal. We prepare the English text and the Arabic version first.

Home or hospital visit

We come to your home, hospital or office. Price on request, plus the Dubai private notary government fee of AED 1,000 per trip outside the place of work.

Online

UAE law lets a notary use IT tools in place of personal appearance (Federal Decree-Law No. 20 of 2022, Article 18). Our e-notary guide explains it. The Ministry of Justice also runs a digital power of attorney service signed with UAE PASS, for POAs drafted without a notary.

Why a sale needs its own power

A sale is not everyday management. UAE civil law says an act beyond management needs a special agency that names the type of act, and sale is listed (Federal Decree-Law No. 25 of 2025, Article 870). A power drafted in broad words covers management only (Article 871).

So the document must say, in plain words, that the agent may sell this property.

What to write in it

  • The property: unit, building, area, and the title or plot number if you have it.
  • The sale: find a buyer, agree the price, and sign the sale contract.
  • The price rule: any price your agent accepts, or no less than an amount you set.
  • The money: who receives it and how. Name it clearly.
  • The transfer: sign transfer papers for you.
  • Buying: if you want your agent to buy property, name it in the same way. Include the property, or the budget and type.
  • The end: a date, or the day of the sale.

What the notary does and does not do

The notary public attests your signature. The notary does not register property rights. Dubai Law No. 4 of 2013 bars a notary from real property rights and matters reserved to another authority (Article 21).

The transfer happens at the authority that deals with property. Ask the office, or the buyer's side, what your agent must bring.

  • A general power. Broad words may not be accepted for a sale.
  • A wrong unit or plot number.
  • No price rule. The agent should know the lowest price you accept.
  • Names that differ from the passport.
  • No end date. The law sets no fixed term. The document's own term applies (Article 897).

If you sign abroad, you use a notary in your country. The document then needs MOFAIC attestation in the UAE. MOFAIC works online only. It charges AED 150 for a power of attorney of a personal nature and AED 2,000 for a general or commercial one.

Frequently asked questions

Can someone sell my property with a power of attorney?

Yes, if the document names the sale and the property. A power in broad words is not enough for a sale.

Can the same document let my agent buy property?

It can, if you write the purchase in. Name the property or the budget and type. A separate document for each act is often easier to use.

Does the notary handle the property transfer?

No. The notary attests your signature. The transfer is completed at the authority that handles property.

Can I cancel it?

Yes. The principal can revoke the agency (Article 898). The Dubai Land Department publishes a free revocation service for a power of attorney registered with it.
